iDefrag License Agreement
We’ve tried to write this in plain English, as far as is possible. There are three types of license available:

If you don’t agree to the terms of the license, you can delete the software and request a refund.
Normal license
You can choose from either personal or business use.
Personal use
The normal license entitles you to run one copy of iDefrag on any machine you (or your immediate family) directly owns. You may leave it installed on family members’ machines, as long as only one copy runs at a time.
You must not use the software on machines other than those owned by you and your immediate family if you have this type of license.
Business use
The normal license entitles you to install and run one copy of iDefrag on any machine your business owns. If you wish to run it on another machine, you will need to uninstall it from the first one, and so on.
You must not use the software on machines other than those owned by your business if you hvae this type of license.
Workshop license
A workshop license entitles you to run iDefrag on machines that are owned by a third party (other than you and your immediate family).
Warning
If you have a workshop license and you install the software on a customer’s
machine, you must make sure that you uninstall it correctly afterwards — in
particular, please be sure to delete the folder /Library/Application
Support/iDefrag.
To avoid problems, we recommend that workshop users make use of Target Disk Mode rather than installing on customers’ machines.
Site license
A site license is intended for use by businesses or universities, and allows the organisation in question to run a certain number of copies on any machines owned or operated by that organisation.
If you would like a site license, contact us to let us know how many copies you wish to be able to use.
General terms
If one of the terms of this license is held to be void or unenforceable by a court, the remainder of the license will still apply.
Allowed
You can transfer your license to another person; let us know if you do this, so that we can update our records.
Terminating your license. You can do this at any time, for any reason. We may terminate licenses for the following reasons:
- If we discover you have uploaded the software, or the license key, to a file-sharing service, or are sharing it through a peer-to-peer system.
- If the payment you made in respect of your license is reversed.
- If you send abusive messages to our support staff (you will get one warning about this; if you ignore it, we will terminate your license).
- If we refund your money, for whatever reason.
Note
Terminating your license will not result in a refund (though if we refund your money, it will terminate the license unless we tell you otherwise).
Making a back-up. It’s perfectly OK to make your own back-up of the software and the license key, just as long as it’s for your own personal use.
Tip
The license key can be kept in paper form!
You can scan it back in, or take a photograph, and the scanned or photographed image will work in the licensing window.
Not Allowed
- “Sharing” the software on the Internet. Sales of iDefrag support the families of our staff; if you upload it to a public file-sharing service, you’re putting our livelihood at risk and we won‘t be able to carry on making the software you love. So we don’t allow that.
- Renting, leasing, or sublicensing. We like to have a connection with our customers. These arrangements break that, and may also create a support burden that we wouldn’t be able to cope with. So we don’t allow them.
- Modifying the software. Doing this will put your data at risk (and the data of others, if you upload your modified version somewhere). There have previously been pirated versions uploaded to the Internet that have destroyed peoples’ data because of careless changes made by the person responsible. This makes us sad. So we don’t allow it.
Liability
Our maximum liability to you is the cost of the software. While we take great care when writing our software to ensure that it works as intended, factors outside of our control can still result in data loss and so we expect customers to take appropriate precautions with their valuable data.
The software is provided as-is, and we disclaim all other warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
Governing Law
To provide us all with a little certainty, all of the licenses are covered by and should be understood in accordance with the laws in force in England. The application of conflict of law rules or the United Nations Convention on Contracts for the International Sale of Goods are expressly excluded.
If there’s a dispute we can’t solve by talking to one another, you agree to submit to the jurisdiction of an English court as determined by our legal representatives at the time of the dispute.
